Trademark registration process
Registering a trademark with IPONZ involves several steps. We handle most of this for you.
Preliminary searches
We search existing trademarks to check if your mark is likely to be registrable and identify any potential conflicts.
Application preparation
We prepare your application, including the specification of goods and services your trademark will cover. Getting this right is important for the scope of your protection.
Filing and examination
We file your application with IPONZ and respond to any examination issues raised by the examiner.
Acceptance and registration
Once accepted, your trademark is advertised for opposition. If no opposition is filed, it proceeds to registration.
The process usually takes four to eight months from filing to registration, assuming no complications.
Employment and contractor agreements
Clear ownership provisions in employment and contractor agreements prevent disputes about who owns IP created for your business.
Key provisions to include:
- IP assignment - All IP created in the course of employment belongs to the employer
- Moral rights waiver - Where appropriate under copyright law
- Confidentiality obligations - Protection for trade secrets
- Post-employment restrictions - Where appropriate for the role
For contractors, IP assignment is particularly important. Unlike employees, contractors own the IP they create unless there is an agreement to the contrary. This matters a lot if you contract someone to produce work for you.
Record keeping

- Document when creative works were created
- Maintain signed employment and contractor agreements
- Record any IP transfers or licences
